The Transport and Tourism Committee of the European Parliament has approved the review of EC Regulations 3821/85 and 561/2006 regulating the use of tachographs on the part of transport professionals to improve the current legislative framework and be able to effectively fight fraud and favour the use of new technologies.
The proposal, defended by Romanian Euro MP Silvia-Adriana Ticau, supports the use of cost-free satellite positioning, the non-establishment of automatic fines via wireless controls, the removal of tachograph seals only by authorized repair shops, training control officers and harmonising sanctions in the case of serious breaches, as well as studying the impact of converging all the cards used by professional drivers into a single one, particularly in relation to driver's licences and driver's cards.
The European Road Haulers Association (UETR) has come out in favour of these calls but not of other points Ms Ticau mentioned in her speech, in particular with regard to work times and subsidiary liability. The UETR considers that the approved definition of daily work times is based only on obsolete legal cases and violates the definition contained in Directive 2002/15/EC which expressly establishes that interruptions and breaks cannot be considered work time.
